This Acceptable Use Policy (“AUP”) outlines the rules and guidelines for using the services provided by Numberify Inc. (“Numberify,” “we,” “us,” “our”). All users of our services (“you,” “your,” “users”) are required to comply with this AUP. By using our services, you agree to adhere to the terms of this AUP. Failure to comply with this policy may result in suspension, termination of services, or legal action.

1. Purpose
This AUP is designed to ensure the responsible use of Numberify services, to promote a safe and positive environment, and to protect the integrity of our platform. It sets forth the acceptable uses of our telecommunications services, including but not limited to voice services, SMS messaging, and access to the Mobyx softphone application.

2. Prohibited Activities
You may not use Numberify services to engage in any illegal, abusive, or harmful activities. The following actions are prohibited:
• Unlawful Use: Using our services to engage in or support any activity that violates applicable laws or regulations, including but not limited to fraud, harassment, impersonation, identity theft, or distribution of malware.
• Spamming: Using Numberify services to send unsolicited bulk messages (spam), including but not limited to SMS spam, phishing, or promotional messages without proper consent.
• Automated or Unsolicited Messaging: Engaging in any form of A2P (application-to-person) messaging or sending bulk or automated messages through our services without authorization. Our services are intended for person-to-person (P2P) communication only.
• Hate Speech or Harassment: Using our services to transmit or promote content that is offensive, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
• Infringing Content: Using our services to transmit or share content that violates intellectual property rights, privacy rights, or any other rights of third parties.
• Misleading or Deceptive Practices: Engaging in activities that involve the distribution of false, misleading, or deceptive information through our platform.
• Unauthorized Access: Attempting to gain unauthorized access to any network, system, service, or account. This includes hacking, reverse engineering, or any activity designed to compromise the security of our services.
• Network Abuse: Engaging in any activity that disrupts or degrades the integrity or performance of our services, including but not limited to denial-of-service (DoS) attacks, interference with other users' ability to use our services, or excessive bandwidth usage.

3. Voice and SMS Messaging Usage
The following guidelines apply specifically to the use of Numberify voice and SMS messaging services:
• Person-to-Person (P2P) Messaging: Our SMS services are intended for personal communication between individual users. Commercial, bulk, or automated messaging (A2P) is strictly prohibited unless expressly authorized by Numberify and fully compliant with applicable regulations.
• Fair Use Policy for Voice Services: Calls made between users of the Mobyx application are free, subject to fair usage policies. Excessive use that appears to be intended to abuse or bypass normal telecommunication charges will be subject to restriction or termination.
• Content Restrictions: You are not permitted to use our voice or SMS services to transmit content that:
o Promotes illegal activities or violates applicable laws.
o Contains offensive, abusive, or inappropriate material.
o Violates the rights of third parties, including intellectual property rights or privacy rights.

4. Security
You are responsible for maintaining the security of your account and any devices used to access Numberify services. This includes:
• Protecting your account credentials (username, password) from unauthorized access.
• Ensuring that your device is protected against malware, viruses, or any other malicious software.
Numberify will not be liable for any loss or damage arising from unauthorized access to your account due to your failure to maintain appropriate security measures.

5. Monitoring and Enforcement
Numberify reserves the right to monitor usage of its services to ensure compliance with this AUP. We may investigate any potential violations of this policy and take appropriate action, including but not limited to:
• Suspension or Termination: If we determine that you have violated this AUP, we may suspend or terminate your access to our services, without notice.
• Reporting Violations: We reserve the right to report any activities that we believe to be unlawful to appropriate authorities, and to cooperate with law enforcement agencies in the investigation of such violations.

6. Reporting Violations

7. Legal Compliance
You agree to comply with all applicable laws, regulations, and rules regarding your use of Numberify services. You are responsible for ensuring that your use of our services does not violate any applicable laws or third-party rights, including privacy rights and intellectual property laws.

Numberify reserves the right to restrict, modify, or discontinue any aspect of our services at any time, for any reason, and without prior notice. We may also impose limits on certain features or restrict your access to parts or all of our services, without notice or liability, in order to enforce compliance with this AUP.

9. Liability for Violations
You agree that you will be liable for any damages, costs, and expenses (including legal fees) incurred by Numberify as a result of any violation of this AUP by you or any third party using your account. You are also responsible for any third-party claims arising out of your use of our services in violation of this AUP.
