If you are using our services on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Services Overview
Numberify provides various telecommunications services, including but not limited to:
• Number Parking: Users can park their existing phone numbers with Numberify while maintaining the ability to make and receive calls and texts using our softphone application, Mobyx. We also offer pay-as-you-go options for flexibility.
• Global Calling: We offer low-cost international calling services accessible from anywhere in the world without the need for a VPN. Users can review specific calling rates on our website.
• Privacy Protection: Users can obtain secondary phone numbers to protect their personal information and maintain privacy.
• Vanity Numbers: Users have the option to select personalized or easy-to-remember phone numbers, subject to availability and regulatory approval.
• Mobyx Free Calls: Calls made between users of the Mobyx application are free of charge, subject to our fair usage policies.

5. Account Registration
To access and use our services, you must register an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify Numberify immediately of any unauthorized use or security breach of your account. Numberify is not liable for any loss or damage resulting from your failure to comply with this obligation.

6. Number Porting and Vanity Numbers
• Number Porting: Users may request to port their existing phone numbers to Numberify. By initiating a porting request, you authorize Numberify to act on your behalf to facilitate the transfer. The porting process typically takes 3-7 business days, though this timeframe may vary based on third-party carriers and other factors beyond our control.
• Vanity Numbers: Vanity numbers are subject to availability and may require additional regulatory approvals. The process for acquiring a vanity number typically takes 3-10 business days. Numberify does not guarantee the availability of specific vanity numbers.

7. Pricing, Billing, and Payment
• Number Parking: The fee for number parking is $3 per month per phone number. This fee includes the ability to use our softphone, Mobyx, to make and receive calls and texts.
• Global Calling Rates: Global calling rates are determined by the destination and are subject to change. Users can view current rates on our website. Global calling services are typically billed on a pay-as-you-go basis unless otherwise specified.
• Pay-as-You-Go: For users on a pay-as-you-go plan, charges are incurred based on usage. Users must maintain sufficient funds in their account to cover ongoing usage. Failure to maintain a positive balance may result in service suspension.
• Payment Terms: All payments are due upon invoicing and must be made in the currency specified by Numberify. Failure to make timely payments may result in service suspension or termination. Users may be subject to late fees, reactivation fees, and other penalties as specified in their service agreement.

8. Internet Connectivity
Our services require an active and reliable internet connection. Users are responsible for ensuring that they have adequate internet access to use the services. Numberify is not liable for any service interruptions or performance issues due to insufficient or unavailable internet connectivity.

9. Supported and Unsupported Services
• Supported Services: Numberify supports the reception of SMS messages, including bank verification codes, and can be used for registering on platforms such as WeChat, TikTok, and Xiaohongshu.
• Unsupported Services: Numberify numbers are not supported for use with WhatsApp or Discord registrations. Attempting to use our numbers for unsupported services may result in failed registrations or other service limitations.

10. Free Calls Between Mobyx Users
Calls between Mobyx users are free of charge, subject to fair usage policies. Numberify reserves the right to monitor usage and impose corrective actions, such as service restrictions or account termination, in cases of abuse or misuse.

11. Privacy and Data Protection
Your privacy is important to us. Numberify collects, uses, and stores your personal data in accordance with our Privacy Policy, which forms an integral part of these Terms. By using our services, you consent to the collection and use of your data as described in the Privacy Policy. We are committed to protecting your information and will not share it with third parties except as required by law or as necessary to provide our services.

12. Refund Policy
Due to the nature of telecommunications services, all sales are final, and services provided by Numberify are non-refundable. This includes but is not limited to number parking fees, global calling charges, vanity number purchases, and any other associated fees. Once a service is purchased or a number is assigned, it cannot be returned, exchanged, or refunded.

13. Limitation of Liability
To the fullest extent permitted by law, Numberify disclaims all warranties, express or implied, regarding the operation of our services, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Numberify is not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of our services. Our total liability for any claims arising out of or relating to our services will not exceed the amount paid by you for the specific service giving rise to the claim.

14. Service Modifications and Termination

• Termination by Numberify: We may terminate or suspend your account immediately, without notice, if you breach these Terms, engage in fraudulent or illegal activities, or if your continued use of the services poses a risk to Numberify or other users. • Termination by User: You may terminate your account at any time by contacting customer support. Upon termination, you will no longer have access to the services, and any outstanding balances must be paid in full.

These Terms shall be governed by and construed in accordance with the laws of the state in which Numberify Inc. is incorporated, without regard to its conflict of law principles. If arbitration is not feasible, any legal action shall be brought exclusively in the courts located in California, and you consent to the jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining Terms, which shall remain in full force and effect.
